Welcome to Flyshot Outfitters. These Terms of Service ("Terms") govern your use of the Flyshot Outfitters LLC website and your engagement with our guided fishing services. By accessing our website or booking a trip, you agree to be bound by these Terms.

1. Business Entity and Licensing Flyshot Outfitters LLC operates as a licensed outfitting business in the State of Montana (Montana Outfitter #29575). All guided trips are conducted in compliance with the regulations set forth by Montana Fish, Wildlife & Parks (FWP) and applicable federal land management agencies.

2. Assumption of Risk and Liability Fly fishing, wading, and boating on rivers involve inherent risks, including but not limited to environmental hazards, weather changes, and physical exertion.

  • By booking a trip, you acknowledge these inherent risks.

  • All clients are required to review and sign a comprehensive Acknowledgment of Risk and Liability Waiver prior to the commencement of any guided trip. Refusal to sign this waiver will result in the cancellation of your trip without a refund.

3. Guide Staffing and Operations Flyshot Outfitters LLC contracts with highly qualified, licensed Montana fishing guides.

  • Independent Contractors: All guides utilized by Flyshot Outfitters LLC, with the exception of the operating Outfitter, operate strictly as independent contractors. While Flyshot Outfitters LLC manages the booking and payment process to ensure a seamless client experience, the independent contractor guide is solely responsible for the safe and lawful execution of your trip on the water.

4. Client Conduct and Right to Refuse Service We are committed to providing a safe, respectful, and high-quality environment for our clients and our guides.

  • Clients are expected to follow all safety instructions provided by their guide and adhere to Montana fishing regulations.

  • Flyshot Outfitters LLC and its contracted guides reserve the right to terminate a trip immediately, without refund, if a client engages in unsafe behavior, excessive intoxication, or abusive conduct toward the guide, other anglers, or the environment.

5. Related Policies Your booking is also governed by our specific operational policies. Please review the following pages for detailed terms regarding your financial and logistical commitments:

  • Cancellation Policy: Outlines our strict 30-day nonrefundable window and guide payout protections.

6. Intellectual Property All content on this website, including text, logos, graphics, and photography, is the property of Flyshot Outfitters LLC or its content creators and is protected by copyright laws. You may not reproduce, distribute, or use any content without our express written permission.

7. Governing Law These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Montana. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Gallatin County, Montana.

8. Changes to Terms We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our website or services following any changes indicates your acceptance of the new Terms.

9. Photography and Media Release During the course of a guided trip, Flyshot Outfitters LLC or its contracted guides may take photographs or video footage of the experience, which may include images of clients.

  • By booking a trip, you grant Flyshot Outfitters LLC a perpetual, royalty-free, and world-wide license to use such media for promotional, marketing, and advertising purposes, including but not limited to our website, social media, and print materials.

  • If you prefer not to have your image used for marketing purposes, please notify us in writing via email (info@flyshotoutfitters.com) prior to your trip date.
